2. Breach of Contract

Plaintiffs allege:

  • Plaintiffs complied with all conditions precedent.
  • Defendant breached the policy by refusing to pay benefits without reasonable basis.

3. Violations of the Texas Insurance Code, Chapter 541

Plaintiffs assert that the insurer engaged in unfair claim settlement practices, including:

  • Misrepresenting policy terms
  • Failing to conduct a reasonable investigation
  • Wrongfully and in bad faith denying the UM/UIM claim
